The author presents the "Constitutional State" as a battlefield. From above, it is seeked to confer that status to the new world power, correlate and political-military arm of private bureaucracies. It is the globalization strategy -which reduces democracy to pure formalistic proceduralism- and that can only generate from below global resistance: programmatic and organized resistance that seek to build another possible world, on one hand, and irrational resistance, incapable of political articulation on the other. The author goes through Hinkelammert’s thought , highlighting the criticism he elaborates towards the fetishism of commodities, of money and of capital, and his asset of a conflict between legitimate rebellion against despotic law, and idolatry of the law.
